Polarity Plan™ – Terms of Service

These Terms of Service (“Terms”) govern your use of the Polarity Plan™ application (“App”). By creating an account or using the App, you agree to these Terms.

1. Who We Are

The Polarity Plan™ App is operated by Polarity Plan, Inc. The App helps individuals, coaches, leaders, and trainers learn about and work with polarities using structured exercises and AI-assisted guidance.

2. Eligibility

• You must be at least 16 years old to use the App.
• If you are under 18, you may only use the App with parental or guardian consent.
• By using the App, you represent that you have the legal capacity to enter into these Terms.

3. Accounts

• To use the App, you must create an account using your email address and a secure password, or by signing in via Google SSO.
• You are responsible for maintaining the confidentiality of your account and password.
• You agree not to share your login credentials with others.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of the App

• The App is provided for personal and professional development purposes.
• You agree not to misuse the App, including:
  • Attempting to access data or systems without authorization.
  • Uploading malicious code.
  • Using the App in a way that violates applicable law.
• We may suspend or terminate access if we reasonably believe your use threatens the security, integrity, or availability of the App.

5. AI Features

• A central feature of the App is its AI-assisted “Polarity Plan” builder. When you interact with his feature, your input is processed by OpenAI or Anthropic under GDPR-compliant data privacy agreements.
• Responses generated by the AI are for educational and developmental purposes only. They should not be relied upon as legal, medical, or psychological advice.
• You are responsible for how you apply insights gained from the AI. We cannot guarantee the accuracy, completeness, or usefulness of AI outputs.

6. Intellectual Property

• All content in the App, including exercises, text, graphics, and software, is owned by Polarity Plan™ or its licensors.
• You may not copy, distribute, or create derivative works from the App content without our permission.
• You retain ownership of any content you input (e.g. your notes and polarity plans). By using the App, you grant us a limited license to process that content solely to provide the services.

7. Payments

• Full-featured use of this App requires payment. Fees and payment terms will be presented before purchase.
• All payments are non-refundable unless otherwise required by law.
• EU consumers have the right to cancel within 14 days of purchase and receive a full refund, unless they choose to start using the paid features immediately, in which case they acknowledge that the right of withdrawal is waived once service begins.

8. Data Privacy

• Our use of your personal data is governed by our Privacy Policy.
• Key points:
  • We collect account details, input text (e.g. your polarity plans), and usage data.
  • Data may be processed by secure US-based cloud providers, as listed in our Privacy Policy.
  • You have GDPR rights to access, correct, delete, and export your data.

9. Availability & Changes

• The App is provided on an “as is” and “as available” basis.
• We make reasonable efforts to keep it available, but we do not guarantee uninterrupted access.
• We may modify or discontinue features at any time, with or without notice.

10. Disclaimer & Limitation of Liability

• The App is intended as a learning and coaching tool.
• We disclaim liability for decisions you make based on AI responses or exercises within the App.
• To the maximum extent permitted by law, Polarity Plan, Inc is not liable for any indirect, incidental, or consequential damages.
• Our total liability for any claim related to the App is limited to the amount you paid us in the 12 months prior to the claim (if any).

11. Termination

• You may delete your account at any time.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your right to use the App ends immediately, but relevant sections of these Terms (e.g. Intellectual Property, Disclaimer, Liability) will continue to apply.
• When you delete your account, your personal data will be deleted or anonymized in accordance with our Privacy Policy.

12. Governing Law

• These Terms are governed by the laws of California.
• Any disputes will be subject to the exclusive jurisdiction of the courts of Walnut Creek, CA, US.

13. Changes to Terms

• We may update these Terms from time to time.
• If we make material changes, we will notify you via the App or by email.
• Your continued use of the App after changes indicates your acceptance of the new Terms.
